Provincial People's Committee
1. The Provincial People's Committee handles work according
to the functions and tasks prescribed in the Law on Local Government
Organization 2015 and other legal documents; collectively discusses and decides
by majority on issues specified in Article 21 of the Law on Local Government
Organization 2015 and other issues that the law stipulates are under the
authority of the Provincial People's Committee.
2. Methods of handling work of the Provincial People's Committee:
a) Discuss and vote on each issue at regular or
extraordinary meetings of the Provincial People's Committee; The decision of
the Provincial People's Committee must be approved by more than half of the
total number of members of the Provincial People's Committee. In case the number of votes in favor and against are equal,
the decision shall be based on the opinion of the Chairman of the Provincial
People's Committee;
b) For some issues that are urgent or do not necessarily
require a collective discussion, the Provincial People's Committee Office
consults with the Chairman of the Provincial People's Committee to send all
documents and written request to each member of the Provincial People's
Committee for their opinion;
- If the issue is agreed by more than half of the Provincial
People's Committee members, the presiding unit will draft a complete document,
send it to the Provincial People's Committee Office for verification, and
submit it to the Chairman of the Provincial People's Committee for decision.
- If more than half of the Provincial People's Committee
members do not agree, the Provincial People's Committee Office shall report to
the Chairman of the Provincial People's Committee for decision to be submitted
at the nearest meeting of the Provincial People's Committee for discussion and
decision.
Within 05 (five) working days from the date of receiving the
request for opinions, members of the Provincial People's Committee shall
respond in writing (except in cases where the request requires a specific
response date). After the above deadline, if Provincial People's Committee
members have no opinions, they will be considered to agree and be responsible
to the Provincial People's Committee for the content for which opinions have
been requested.
*/ Responsibilities, scope, tasks, and powers of handling work
of the Chairman of the Provincial People's Committee
1. The Chairman of the Provincial People's Committee shall
handle work according to the tasks, powers, scope and responsibilities
prescribed in Article 22 and Article 121 of the Law on Local Government
Organization 2015. Direct the handling of work under the authority of the
Provincial People's Committee and Chairman of the Provincial People's Committee
according to the provisions of law; directly direct and manage major, important
tasks and strategic, long-term issues of the province.
2. The Chairman of the Provincial People's Committee assigns
work to the Vice Chairmen of the Provincial People's Committee and members of
the Provincial People's Committee. Depending on the actual situation, the
Chairman of the Provincial People's Committee may adjust the work assignment of
the Vice Chairman of the Provincial People's Committee and members of the
Provincial People's Committee.
3. The Chairman of the Provincial People's Committee
directly directs the resolution or assigns the Vice Chairman of the Provincial
People's Committee to direct the resolution of issues related to many sectors,
fields, and localities in the province. If necessary, the Chairman of the
Provincial People's Committee may establish advisory groups to assist the
Chairman of the Provincial People's Committee in handling work.
4. In the process of handling work within his authority, if
deemed necessary, the Chairman of the Provincial People's Committee shall seek
the opinions of the Vice Chairmen of the Provincial People's Committee before
making a decision.
5. When the Chairman of the Provincial People's Committee is
absent, the Chairman of the Provincial People's Committee authorizes a Vice
Chairman of the Provincial People's Committee to, on behalf of the Chairman of
the Provincial People's Committee, lead the work of the Provincial People's
Committee and handle the work assigned by the Chairman of the Provincial
People's Committee according to regulations;
6. When the Vice Chairman of the Provincial People's
Committee is absent, the Chairman of the Provincial People's Committee shall
directly handle the work or assign another Vice Chairman of the Provincial
People's Committee to handle the work on behalf of the absent Vice Chairman of
the Provincial People's Committee. If
necessary, the Chairman of the Provincial People's Committee may assign another
Vice Chairman of the Provincial People's Committee to directly direct and
resolve specific issues on behalf of the Chairman or Vice Chairman of the
Provincial People's Committee who has been assigned to be in charge, to ensure
the requirements for performing the general tasks of the Provincial People's
Committee.
7. In case it is deemed necessary due to the importance and
urgency of the work, the Chairman of the Provincial People's Committee may
directly direct the handling of work assigned to the Vice Chairman of the
Provincial People's Committee; at the same time, assign the Office of the
Provincial People's Committee to notify the Vice Chairman of the Provincial
People's Committee.

Chairman of the Provincial People's Committee
1. The Vice Chairman of the Provincial People's Committee
handles work within the scope and responsibilities prescribed in Article 122 of
the Law on Local Government Organization 2015.
2. Each Vice Chairman of the Provincial People's Committee
is assigned by the Chairman of the Provincial People's Committee to assist the
Chairman of the Provincial People's Committee in directing, operating, and
regularly handling work according to specific sectors and fields; to act as
Chairman, Vice Chairman of Councils, Head, Deputy Head of Steering Committees
according to relevant fields; to direct, monitor activities and maintain
regular contact with a number of agencies and units.
The Vice Chairman of the Provincial People's Committee is
personally responsible before the law, the Chairman of the Provincial People's
Committee, the Provincial People's Committee, and the Provincial People's
Council for performing assigned tasks; together with other members of the
Provincial People's Committee, is collectively responsible for the activities
of the Provincial People's Committee.
3. Within the assigned scope and field, the Vice Chairman of
the Provincial People's Committee has the following tasks and powers:
a) Direct, inspect and urge agencies and units to advise on
the development and implementation of strategies, planning, programs, schemes,
mechanisms, policies and projects for the development of sectors and fields in
accordance with the Party's guidelines and policies and the State's laws, in
accordance with the directives of superiors and the actual situation of the
locality, ensuring feasibility and high efficiency;
b) Direct and inspect agencies, units, and district-level
People's Committees in implementing Party guidelines, State policies and laws,
and tasks within the assigned scope of responsibility. If agencies, units,
district-level People's Councils and district-level People's Committees are
found to issue documents or do things contrary to the law or regulations of the
provincial People's Committee or the Chairman of the provincial People's
Committee, it must report to the Chairman of the provincial People's Committee
to suspend the implementation and propose handling measures according to the
provisions of law;
c) Direct and handle daily arising issues within the scope
of his/her responsibility; research, discover and propose issues regarding
development guidelines, orientations, new or supplemented or amended mechanisms
and policies in the assigned fields, report to the Provincial People's
Committee and the Chairman of the Provincial People's Committee for
consideration and decision;
d) Sign on behalf of the Chairman of the Provincial People's
Committee documents under the authority of the Chairman of the Provincial
People's Committee within the scope of assigned work areas or when authorized;
đ) Carry out and perform other tasks assigned by the
Chairman of the Provincial People's Committee;
e) Monitor, direct, annually review and evaluate the
performance of assigned agencies, units and localities.
4. In the process of performing tasks, if there is an issue
related to the field of work assigned by the Vice Chairman of the Provincial
People's Committee, coordinate with the Vice Chairman of the Provincial
People's Committee to resolve it. In case the Vice Chairmen of the Provincial
People's Committee have different opinions, the Vice Chairman of the Provincial
People's Committee who is in charge of handling that work shall report to the
Chairman of the Provincial People's Committee for consideration and decision.
If important and sensitive issues arise in the field of responsibility, related
issues or in the field directly under the responsibility of the Chairman of the
Provincial People's Committee, issues arising outside the plan, issues not yet
regulated, issues that need to be discussed at the Provincial People's
Committee meeting, the Chairman of the Provincial People's Committee must be
promptly reported.

People's Committee members
The Provincial People's Committee members handle work within
the scope and responsibilities prescribed in Article 123 of the Law on Local
Government Organization 2015 and perform the tasks and powers prescribed in
Article 8 of this Regulation; in addition, the Provincial People's Committee
members are responsible for:
1. Research, advise, propose and participate in handling
work of the Provincial People's Committee; discuss and decide with the
Provincial People's Committee on issues within the tasks and powers of the
Provincial People's Committee.
2. Attend all meetings of the Provincial People's Committee
and respond fully and on time to the contents of requests for opinions sent by
the Chairman of the Provincial People's Committee to the Provincial People's
Committee Office, according to the provisions of Point b, Clause 2, Article 3
of this Regulation; the response must clearly state one of the following
contents: Agree; agree but with additions or amendments; disagree; other
opinions.
3. Handle specific tasks as assigned or authorized by the
Chairman of the Provincial People's Committee and be responsible before the
law, the Provincial People's Committee, and the Chairman of the Provincial
People's Committee for assigned or authorized tasks.
4. The Provincial People's Committee members can receive and
send information, documents, petitions, meeting invitations, and exchange
opinions on related work via the official email box or the Executive Document
Management System of their agency or unit.
5. The Provincial People's Committee members are not allowed
to say or do anything contrary to the decisions of the Provincial People's
Committee and the Chairman of the Provincial People's Committee. In case of
having different opinions from those regulations, they must still comply but
can continue to present their opinions to the collective People's Committee and
the Chairman of the Provincial People's Committee./.
