Investment procedure

3.1. Investment launched  inside Dong Nam Economic Zone and Industrial zones

Contact office: The investor shall submit the application dossier at the one-stop service point in Management Board of Dong Nam Economic Zone of Nghe An.

The procedure for investment projects launched inside Dong Nam economic zone and industrial zones involves registering and receiving the answer at the one-stop service point in Management Board of Dong Nam Nghe An Economic Zone as presented in the following diagram:  

I. Issuance for the certificate of planning:

Dossier includes: 2 filed copies

- Application form for cartificate of planning 

- Justification on on project investment

- Application file on mining for material (for the project related to mining).

II. Issuance for the certificate of investment:

1. For domestic investment projects with a capital from VND 15 billion up to VND 300 billion; without registration for business establishment; not belonging to conditional investment sector and not belonging to the sector approved for investment by the Prime Minister.

Dossier: 3 filed copies, including at least one original copy.

- Application form for issuance of investment certificate in line with the Annex I-1 attached at the Decision N0 1088/2006/QD-BKH. (If registration for business establishment is needed, the Form in the Annex I-2 shall be applied).

- Copy with juridical seal related to legal status of investor: Decision for business establishment or business license or other similar documents (for the enterprise), passport or identification card (for the individual).

- Certificate of planning for master plan of the factory.

- Justification on financial ability of investor (prepared and liable by the investor).

- Baseline design  approved by the authority .

- Report on environment impact assessment approved or registered and certified for environmental protection in line with regulation.

- Investment project has been approved.

Time to answer: not later than 7 working days (15 days as stipulated by Law) as from the date valid dossier accepted.

1.     For the investment project with a capital from VND 15 billion up to VND 300 billion; with registration for business establishment; not belonging to conditional investment sector and not belonging to the sector approved for investment by the Prime Minister.

Dossier: 3 files including at least one original file

- Application form for issuance of investment certificate (Available Form)

- Dossier regulated in the article a. part 1.

- Additional dossier: Dossier for business establishment (dossier for business registration) in accordance with each type of business, as follows:

- List of members for  limited liability company with more than one member (Annex I-8); list of founding shareholders for shareholding company (Annex I-9); list of founding members for partnership company (Annex I-10) at the Decision N0 1088/2006/QD-BKH.

- Draft of business charter (in line with regulation at Article 22 Law on Enterprise).

- Business cooperation contract (for the BCC investment case)

- Joint ventures contract (for establishment of joint ventures with foreign investor),

- Valid copy of  career certificate (for business activities in need of career certificate as stipulated by Law),

- Certification on legal capital (for business career in need of legal capital as stipulated by Law).

Time to answer: not later than 7 working days (15 days as stipulated by Law) as from the date valid dossier accepted.

3. Other supplementary documents:

3.1. For projects with investment capital of from VND 300 billion or higher, it is necessary to supplement following documents:

                Economic and technical explanation on the project (inluding following main contents: purpose, scale, investment location; investment capital, progress of project implementation; land use need, solution on technology and solution on environment).

3.2. In case of the project with conditional investment, supplementary documents are as follows:

- Explanation on the ability to satisfy conditions of the project as stipulated by Law on Investment and relevant laws (Article 29 of Law on Investment  and Annex C of Decree 108).

The investor shall submit 4 application files inluding at least 1 original copy ; The processing time is within 20 working days (30 days as stipulated by Law ) from the date valid dossier accepted.

3.3. For projects applied for state budget to invest, supplementary documents include budget documents approved by the authority.

3.4. Forprojects approved by the Prime Minister, the investor shall submit 10 application files inluding at least 1 original file; the processing time is within 40 working days (55 days as stipulated by Law ) from the date valid dossier accepted.

 

3.2. Investment project launched outside the Economic zone and industrial zones

Contact office: Following the inter-departmental one-stop service rule, the investor shall submit the application at the inter-departmental one-stop service point of Nghe An people’s committee based at the Department of Planning and Investment.

Details as follows

3.2.1. Approval for investment proposals:

- Authority:

+ Prime Minister shall approve investment policy for projects as stipulated at Article 37, Decree N0 108/2006/ND-CP dated 22/9/2006 issued by Government regulating and guiding to implement some articles of Investment Law (see the above).

+ Nghe An Provincial People’s Committee shall approve investment policy for the remaining projects.

- Processing time is within 40 days maximum.

Application file includes:

1.1. Submitted application to implement the project by the investor

1.2. Dossier certifying legal status of the Enterprise (Business Certificate for business lines fitted to project purpose, passport);

1.3. Initial project proposal includes the following main content:

- Project title, form of investment; purpose, scale of project (workitems, construction area, density, use are and investment portion of each workitem);

- Implementation location, bordering location of the land site of the project (border to the North, to the South,...); situation of the land site (purpose of land site use, available physical infrastructure); 

- Total investment capital; capital resource, capital contribution, contribution progress.

- Progress of project implementation (according to each quarter) and operation time of the project.

- Number of labour, estimated budget contribution; impact level on environment; utilzation of available social infrastructure and technical infrastructure or new investment, etc.

1.4. Explanation on financial ability to implement the project (Form), attached the 2 year recent audited Financial Report of the business.

Agreement  on the loan committed by the Bank /Credit Organization (for the loan if any).

1.5. Justification on experience of implementing similar projects which the business have directly invested or participated in investment (project title, investment location, scale, total investment, project implementation progress, land use effectiveness, number of labourers, budget contribution, financial duties related to land use).

1.6. Committment document by the investor  if the proposa lis accepted, stating committment on the implementation progress, labor employment, full compliance with the state budget regulations and the land law.

3.2.2. Appraisal and approval for construction plans:

- Decided by: Nghe An people’s committee;

- Processing time: 15 working days maximum

- Dossier:

a) Procedure of appraising master plan for construction at the rates of 1/2000, 1/5000 (regional planning) and detailed  plan  for  construction at the rate of 1/500

+ Submitted application by the investor.

                + Decision on design (photocopy if any).

                + Decision on survey to select the project site (photocopy accepted).

                + Decision to select consultant for design on construction issued by the Authority attached with the capability dossier and the career certificate of the consultant (copy with juridical seal).

                + Comments by local inhabitants in the planned construction site.

                + Announcement related to approval for master plan by the Council of Architecture and Master plan or Nghe An PPC (if any).

                + Plan drawing: needs to fully follow the content and rate requirements and has been approved by authority. It should include:

                * Land site map;

                * Status map on landscape, architecture and evaluation on construction land;

                * Status map on physical infrastructure and environmental protection (for the plan rated at 1/2000)

                * Map of the whole planning for land use (signed and sealed);

                * Organizational diagram for architectural space (signed and sealed);

                * Map of planned road and red boundary, construction boudary (signed and sealed);

                * Map of planning for other physical infrastructure and environment (for the plan rated at 1/2000);

                * Map of cables and technical pipelines;

                * Justification of the whole master plan;

                * 20 or 25 copies  of justification files enclosed the design drawing on A3 paper for cases approved by the Council of Architecture and Master plan;

                * 1 CD disk storingfiles of the whole project plan.

                - Submitted application: 1 filed copy

b) Procedure for appraisal on the whole planning, master plan for construction; planning for land plots rated at 1/500

+ Submitted application for planning approval by the investor.

                + Report on construction approved by the authority. An adjustment plan is required if adjustment of the project needs to be done.                + Decision on survey to select the location (for the case of surveys to formulate the investment project for new construction) and for plans to divide land plots.

                + Documents related to land use right.

                + Decision on selection of the design consultant for construction issued by the authority attached with the capability dossier and the career certificate of the consultant (original copy or copy with juridical seal).

                + Relevant documents approved by Provincial Party committee, Nghe An people’s committee (if any).

                + Comments by local people related to the construction plan certified by the local authority.

                + Initial design dossier for the construction work (01 file) including the site, sections, surrounding draw on the construction site (for the area in need of physical surrounding landscape, excluded the case of adjustments that do not affect the architetural space that has been approved  and planned).

                + Plan drawings: provide with full information related to the project components and rate, it has to be approved by the authorities of relevant levels. For projects plans for simple functional areas, the dossier can combine the following partial drawings:

                * Drawing 1: includes boundaries of the land site; architectural and surrounding landscape; thew whole land use planning and red boundary, construction boundary, corridor of protection for physical infrastructure system. 

                * Drawing 2: Planning for physical infrastructure system, ground leveling for sewage.

                * Drawing 3: one map analysing and evaluating land use situation, architectural works of physical infrastructure at the time of planning in accordance with the ratio, signed and sealed by the investor and design consultant.

                - Number of filed copies required: 7 filed copies

c) Procedure of selecting the location to survey and plan for construction to be submitted to Nghe An PPC for approval

+ The paper is submitted by the investor.

                + Approval document is issued by the authority

                + Initial report on investment project

                + Official document to confirm financial ability of the investor for project implementation

                + Official document to confirm land use situation, relevance with the master plan, land use plan attached with the agreement form by the locality (district, commune) and the extract from the map of the land site selected for survey and construction.

                - Number of filed copies required: 1 copy

                3.3.3. Procedure for registration/verification for granting the investment certificate

- Decided by Nghe An PPC;

-  Processing time: within 25 working days maximum.

Application file includes:

* Dossier to register for granting the investment certificate:

The following projects are entitled  for registering for grant of investment certificate:

- Domestic investors for investment projects with the scale of from VND 15 billion up to VND 300 billion; not belonging to the list of projects approved for investment by the Prime Minister and not belonging to the conditional investment sector

- Foreign investors for investment projects with the scale of under VND 300 billion and not belonging to the list of conditional investment projects.

- Domestic investors for investment projects with the scale of under VND 15 billion, if they need the confirmation for investment incentives and the grant for investment certificate.

Number of filed copies required: 4 filed copies including at least 1 original filed copy or 1 copy with juridical seal), including:

a. Application form for the investment project (form available).

b.  Dossier certifying the legal status of the investor (similar to the step of approval for investment)

c. Approval for investment issued by the authority (the result of the step1);

d. Investment project document/Decision on the investment project by the investor (signed by Chairman of member Council of limited liability company, Chairman of Management Board of shareholding company, the owner of private enterprise or individual investor);

e. Decision to approve the planning for construction / Planning for sector, product by the authority (result of the step 2);

g. Report to justify financial ability of the investor (the same as the step for investment approval);

h. Dossier for business registration for each type of business (including the business charter, list of members, shareholders ...) for projects related to establishment of economic organizations.

i. Authorized decision/ authorized paper of the investor for the authorized person and valid copies (with juridical seal) of the identified individual papers of the authorized representative.

k. Joint ventures contract for the case of establishing an economic joint venture organization with foreign investors; or business cooperation contract for the case of investment in accordance with the form of business cooperation contract; business Charter and List of members/ shareholders for the case to establish limited liability company/shareholding company/partnership company; Documents, to show the legal status of the founding members/ shareholders.

l. Other relevant documents (comments of line departments, relevant locality if any)

* Verified dossier to grant Investment Certificate:

Projects that need to be verified for granting investment certificate include:

 - Project with the capital scale from VND 300 billion or higher and not belonging to the list of conditional investment sector;

- Project with the capital scale from VND 300 billion or higher and belonging to the list of conditional investment sector;

- Project approved for investment by the Prime Minister.

Dossier: 8 filed copies (including 1 original filed copy in Vietnamese language or English language and one other popular foreign language) prepared in 8 booklets (10 filed booklets shall be prepared for the investment project under approval of the Prime Minister )

a. Application form for granting the investment certificate (Form I-3);

b. Approval for investment issued by the authority (the result of step 1)

c. Investment project document/Decision on the investment project by the investor;

d. Decision to approve the planning for construction / Planning for sector, product by the authority (result of the step 2)

e. Report to justify financial ability of the investor for project implementation (the same as the step for investment approval);

g. Explanation on capability that the investment project shall satisfy conditions in accordance with legal regulations for the project belonging to the conditional investment sector. Investment conditions are stipulated in relevant laws of Vietnam and international commitments stated in the international treaty of which Vietnam is a member.

For projects related to the right of distributrion, right of import and export, it is necessary to supplement:

- Explanation on business conditions, nationality, legal status, form of investment, business service, scale of activities.

- Application to register for the right of import and export (excluding the right of import and export without distribution or activities related to direct sales), or application form for sale activities and activities directly related to purchase of goods (in case of investment to conduct sale activities and activities related to purchase of goods). In the application form, the investor need to state the list of commodity codes for import, export, and distribution.

h. Economic – technical explanation including the following main contents: purpose, scale, investment location; investment capital; progress of project implementation; need of land use; solution on technology and solution on environment (for project with capital scale of from VND 300 billion and higher).

i. Dossier for business registration relevant to each type of economic organization in accordance with legal regulations on business and laws related (including Business Charter, List of Members,  shareholders. ..).

k. File related to legal status of the investor (similar to the step for investment approval)

l. Joint venture Contract for economic joint venture organizations between national investors and foreign investors (Refered to Article 54 Decree 108/2006/ND-CP dated 22/09/2006).

m. Forinvestment projects involving state budget, the official approved document issued by the authority shall be compulsory.

n. For business lines with legal capital, the dossier to register for the investment certificate shall be attached with the official paper approved for legal capital issued by the authorized agency or organization.

o. For business lines requiring a business certificate, the dossier to register for the investment certificate shall be attached with the valid copy of the business certificate of the director (or general director) and/or other individuals as stipulated at Article 9 Decree 102/2010/ND-CP dated 01/10/2010 issued by Government and a confirmation form stating that the person will work for the company.

3.2.4. Feedback on baseline design

- Authorized organizations: Professional management units of construction shall give their comments related to the project.

- Time to process:

+ For projects of group B: 15 working days

+ For projects of group C: 10 working days

- Filed dossier:

- Submitted letter of the investor to appraise for baseline design of the investment project;

                - Duplicated copy of approval paper (with juridical seal) of the competent agency;

                - The design approved.

                - Justification on the project (preppared in line with regulation at article 7 Decree 12/2009/ND-CP);

                - Content of baseline design of the project includes: justification on baseline design and drawings of baseline design (prepared in line with regulations at the article 8, Decree 12/2009/ND-CP).

                - Report on result of survey for construction includes:

                + Report on the result of topography survey of the construction site;

                + Report on the result of geological survey (or hydrogeological survey) of the construction site and other materials (if any).

                - The minutes of survey for construction (topography, geology) recorded by the investor.

                - Oficial documents related to:

                + Detailed planning for construction;

                + Land use right (if any);

                + The use of physical infrastructure system outside the construction works (if any);

                + Safety to operate underground works and other requirements related (if any)

                - The result of awarding for structures (for works as stipulated for structural awarding) including:

                + Decision on approval for architectural solution selected (of the investor).

                + Drawings on architectural solution selected.

                - Business registration of the contractor implementing the survey for construction and the contractor preparing baseline design.

                - Business certificate of the person in chage of survey for construction, the person in charge of baseline design and design for main items (architecture, structures, electricity, water supply).

                - Number of filed dossiers: 1 dossier.

3.2.5. Verification for fire control

- Processed by: Fire Control Division of the Provincial Police;

- Time to process: 10 working days maximum

- Dossier includes:

Dossiers to be submitted for appraisal related to fire control for the project, construction works (as stipulated at Decree N0 46/2012/ND-CP dated 22/5/2012 issued by Government)

a/ For project dossier related to design, plan:

- Application for solution on fire control submitted to authorized agency to appraise and approve for the project or of the investor; if it is authorized for other organization to implement, it is necassary to attach the authorized paper;

- Documents and the detailed drawings rated at 1:500 shall show the requirement on solution of fire control as stipulated at terms 1, 2, 3 and 4 of Article 13 this Decree.

b/ For dossier of baseline design:

- Proposal document related to solution on fire control shall be submitted to the competent agencies for appraisal, approval for the project or of the investor; if it is authorized for other organization to implement, it is necassary to attach the authorized paper;

- Duplicated copy for investment permitted by the authority;

- The drawings and justification on baseline design shall show the requirement on solution of fire control as stipulated at terms  1, 2, 3, 4,5 and 6 of Article 14 this Decree.

c/ For the dossier to approve construction site:

- Document requesting a check and approval for the construction location of fire control by the investor. The document needs to clearly state the scale,  characteristics, potential danger of fire and explosion the current state of  the contruction works, and the relevance of the construction site;

- Duplicated copy of land use certificate or housing property right;

- Drawings, documents that clearly state the situation of the land topography related to fire control such as: refractory step or refractory level of the contruction works, dimension from the scheduled construction works to surrounding construction works, wind direction, and height of the works.

d/ For technical design dossier or drawing design for construction:

- Documents for solution on fire control of the investor; in case the investor authorizes for other organization to implement, it is necassary to attach the authorized paper;

- Duplicated copy of permit for investment issued by the competent agency or planning certificate or land use certificate;

- Drawings and justification on technical design or drawing design for construction related to requirement for fire control as stipulated at items 1, 2, 3, 4, 5 and 6 in Article 14 of this Decree.

Number of filed dossiers: 2 copies certified by the investor.

If the dossier in a foreign language, it must translated into Vietnamese. The applicant shall be responsible for accuracy of the translated version.

6. Environmental protection

a) Registration for environmental protection committment

- Processed by: the district People’s Committee.

- Processing time: 7 working days maximum.

b) Appraisal and approval for report on environmental impact assessment

- Authorized person: The district People’s Committee.

- Processing time :

+ Evaluation process: 30 working days maximum. 45 working days for a complex projects (exluded the time for supplementary documents of the dossier).

+ Approval processing time: 15 working days.

- The dossier includes:

In line with the Article 17, Decree N0 29/2011/ND-CP, the dossier for appraisal and approval of environmental impact assessment includes following documents:

1. Application form of appraisal, approval of environmental impact assessment (Form 1);

2. Report on environmental impact assessment (11 copies; available form for content and cover sheet form 2);

3. Investment project document (feasibility study)

In line with Article 13, Circular N0 26/2011/TT-BTNMT dated 18/7/2011, in addition to the above mentioned dossiers, the applicant(s) may be required to supplement some other documents, respectively as follows:

4. For projects to enlarge and upgrade the capacity of units of production, business operation, service which have been approved for committment on environmental protection or have registered for committing to environmental standard or have  certified the form of environmental protection committment similar to objects from item 1 to item 143 of Annex II Decree N0 29/2011/ND-CP.

It is compulsory to attach one (01) copy of the approved decision on report on environmental impact assessment or certificate for registration for environmental standard, approved decision or certificate related to the project for environmental protection or committment on environmental protection of the production, operation, service units being registered.

5. for projects that have been approved upon report on environmental impact assessment but have not operated, it is compulsory to prepare a report on environmental impact assessment in the following cases:

a) Changing the project location or not implementing the project within thirty six (36) months, as of the time of issuannce on approved decision for report on environmental impact assessment;

b) Enlarging the scale, capacity or changes in technology that affect or result in an increase of the scope of environmental impact or an increase in negative environmental that are not caused by waste  or that cause increases in total solid waste or form new kinds of waste, waste with high polluting ingredients compared to evaluated result, forecasted in the approved report on environmental impact assessment.

It is compulsory to attach one (01) copy of approved decision on report on environmental impact assessment of the previous project.

6. For projects related to minerals mining, it is compulsory to supplement:

- Application form for appraisal and approval of report on environmental impact assessment and project for environmental rehabilitation (form 3)

- 11 project booklets for environmental rehabilitation (form 4).

If the report on environmental impact assessment is approved, but adjustments are required, the supplementary dossier sent to Dept of environmental protection has to include:

- Official explanation of adjustments upon the feedback ofthe Council

- One copy of  report on environmental impact assessment (a project proposal for environmental rehabilitation for projects related to mineral mining) with signature, seal of the investor and signatures of the investor at the footer of each page compalted.

- One compactdisk storing the whole data of report on environmental impact assessment (and a project proposal for invironmental rehabilitation).

3.2.7. Compensation, support and resettlement

- Processing time: 6 months maximum

- Filed dossiers: 04 copies

a. Documents related to land acquisition issued by the district People’s Committee in line with regulation.

b. Decision to establish the Council for land compensation, support, resettlement.

c. Decision on approval for the investment project or approval letter for investment issued by the authorized agency attached with the investment project document.

d. Decision on approval for planning attached with the ground drawing issued by the authority. In case of the investment project constructed along the route, the ground drawings approved by the authority or maping for the routeaccepted by the authorized agency, and the baseline design approved in accrdance with regulation are required to be submitted.

e. The extract from the land map or the extract of supplementary drawings of the land map of the land site collected (for the land area with the land map) or the extract of the measurement of land map (for the land area collected without land map).

g. Submitted letter for land acquisition and appraisal for detailed solution for compensation, support and resettlement of the Council for, enclosed with:

+ Calculation for compensation, support and resettlement of infected households, including: compensation value of land categories; compensation value of house, construction works; compensation value of graves; compensation value of plants, crop, water surface for fishery farming, other livestocks; compensation value, other support; financial charges related to land use deducted in land compensation, support (certified by the local taxation agency); budget for implementation of compensation, support, resettlement;

+ Complete table to show: area, land categories, No. of land plot, land map, location of agricultural land and the origin of land use;

+ Declaration on the land, assets of the owner; the inventory list and the minutes of  compensation prepared by the Council of Compensation, support and resettlement for each infected household (in line with the form enclosed to this regulation) attached with following papers: duplicated copy of valid papers of land use right. If there are no valid papers, it is necessary to have a official document to identify the origin, time of use in line with the form issued by the communal People’s Committee;

+ The meeting minutes for comments from the infected households from land  recovered;

+ Other relevant documents.

h. Decision on land recovery isued by the authority.

3.2.8. Definition of land  price

- Competence to process: Nghe An provincial’ People Committee

- Guideline by Department of Finance

- Time to process: 25 working days maximum

- Filed dossier includes: 3 copies (original or juridical)

+ Proposed document to definite the land price from the investor

+ Application for plan, progress of project implementation from the investor

+ Report on the investment project + Decision on approval for the project by the authority

+ Investment certificate of the competent agency

+ Decision to approve the detailed planning issued by the provincial People’s Committee and the drawings of the construction site approved

+ Extract or extracted measurement of the land map of the land site approved by Department of Natural resources and Environment or certified in line with regulation.

+ The official document related to compensation, clearance of the land completed for implementation of the project issued by the authority.

3.2.9. Land hand-over, rent and grant of land use right

- Competence to decide:

+ The provincial’ People Committee shall consider, decide land hand-over, land rent for economic organization, Vietnamese living abroad, foreign individual.

   (the Provincial PPC shall authorize for Department of Natural resources and Environment to sign the certificate of land use right, the right of housing proprety and other assets engaged with the land site)

+ The district People’s Committee decides land hand-over, land rent for households, individuals;

- Time to process: 30 working days maximum

- The filed dossier includes: 02 files (1 original and one photocopy with juridical seal)

1. Application for land hand-over or for land rent or application for change of land use purpose for land rent or hand-over; application for grant of land use right certificate;

2. Business license (copy with juridical seal); Investment certificate (for Vietnamese living abroad, foreign organization, individual);

3. Investment project attached with the decision of approval on the investment project of the investor or investment project enclosed to investment registration or investment project attached with the investment Certificate granted by the authority in line with regulation of the Law on investment;

4. Detailed planning enclosed to the drawings on planning of construction works approved by the authority and the minutes of land mark;

5. Measurement of the land site or the extract from the land map of the land site approved and certified by the authority.

6. Decision on land acquisition issued by the competent agency and certified documents of the district People’s Committee related to land compensation, clearance completed (for the case of land collected by the State);

7. Committement for environmental protection or Report on environmental impact assessment certified or approved by the authority;

8. Decision to approve land price issued by the provincial People’s Committee or the official paper of Department of Finance related to land price norm for the land site;

9. In addition to the above mentioned documents, some following documents shall be necessary for some another cases:

a) In case the investor applies for the form of land hand-over with land use charge, land rent after the grant of the transfer of land use right or capital contribution with the land use right of the economic organization, households, use the land that the dossier is necessary to have:

- Application for transfer of land use purpose for land rent or land hand-over;

- Contract for transfer of land use right or Contract of capital contribution with  land use right or Contract for lease of land use right for economic organization, individuals use the land;

- Submitted paper of the district People’s Committee to propose transfer of land use purpose for project implementation attached with the complete table;

- Vouchers related to implementation of financial duties in line with regulation.

b) Land use for forestry purpose shall be compulsory to transfer the purpose of use issued by Nghe An PPC for land hand-over or land rent.

c) In case land hand-over to implement the project for housing construction for sale or for lease, Nghe An PPC shall certify purpose of use of land categories to be based for collect chages of land use, land hand-over, land rent. Investment certificate or approval for investment issued by Nghe An PPC.

3.2.10. Permit of construction :

-  Competence to process: Department of Construction;

- Time to process: 20 working days maximum

- Filed dossier:

+ Application form for permit of construction (Form  01 CPXD);

+ Duplicated copy with juridical seal for one of papers related to land use right in accordance with legal regulation on land enclosed to the extract of land map or the land site measurement or maping the land boundary;

+ Two (02) filed copies of design for constrcution:

* Drawings on the land site for construction;

*  Ground, typical sections, vertical section;

* Foundation of the construction works attached with the technical diagram of electricity, water supply, sewerage;

* Photos of the construction works repaired and upgraded.

+ Drawings on detailed ground planning rated (1/500-1/200) approved by the authority.

For construction works of the project appraised for baseline design that the investor shall submit the result of appraisal of baseline design in replace of the above mentioned drawing copies.

In addition to the above filed documents, the investor shall ssupplement some documents for following works:

+ (Status quo file). All photos of surrounding constructions works for high buildings with basement.

  + Agreed documents in accordance with legal regulations from the relevant line agencies for the construction of special works: religious works; construction housing works located in the area infected to dykes, flooding discharge; Historical and cultural works and landscape or in the area of preservation zone of historical, cultural vestiges classified; specially technical infrastructure; construction works at fire danger; environment impacted construction works.
